By accessing the mailerapi website or joining our waitlist, you agree to these Terms of Use and our Privacy Policy. If you do not agree, please do not use the website or submit information to us.
You must be legally able to enter into these terms. If you use the website on behalf of an organization, you represent that you have authority to bind that organization.
2. Website and waitlist
mailerapi is currently in a pre-launch stage. Joining the waitlist expresses interest only; it does not guarantee access, a launch date, specific features, pricing, availability, or service levels. We may decide how and when invitations are offered and may change or discontinue pre-launch plans at any time.
You agree to provide accurate information and to keep any information you submit reasonably current. Additional terms may apply if you are invited to test or use a mailerapi product. Those terms will be presented before that use.
3. Acceptable use
Our Acceptable Use Policy and Email Practices are incorporated into these terms. In particular, mailerapi may not be used for unsolicited email, purchased or scraped lists, phishing, or deceptive sending.
You may not use the website to:
- violate any law or another person's rights;
- submit false, misleading, fraudulent, or harmful information;
- introduce malware or attempt to bypass security or access controls;
- interfere with the website's operation or other people's use;
- scrape, probe, test, or reverse engineer the website except where applicable law expressly permits it; or
- use automated means to create submissions, overload the website, or collect information without permission.
4. Intellectual property

To the fullest extent permitted by law, our total liability for all claims arising from or related to the website or these terms will not exceed US$100. Some jurisdictions do not allow certain limitations, so parts of this section may not apply to you.
9. Indemnity
To the extent permitted by law, you agree to defend, indemnify, and hold harmless mailerapi and its affiliates, officers, employees, and agents from claims, liabilities, damages, losses, and reasonable expenses arising from your misuse of the website, your violation of these terms, or your violation of another person's rights.
10. Changes and termination
We may update these terms by posting a revised version and changing the date above. Your continued use of the website after an update means you accept the revised terms. We may suspend or end access to the website or waitlist at any time, including when we reasonably believe these terms have been violated.
